Terms of service

1. Who we are
SynCaps is provided by Syntagm Ltd, a company registered in England (company number 01895345), whose registered office is at 10 Oxford Road, Abingdon OX14 2DS, United Kingdom. Our VAT number is GB 408679813. In these terms, “we” and “us” mean Syntagm Ltd, and “you” means the person who has the account. You can reach us at [email protected].
2. Early access
SynCaps is in early access. During early access every feature is free, and nothing you do in SynCaps costs you anything. Features may be added, changed or removed as the service develops.
Before we start charging for anything, we will email you and publish new terms. You will be asked to accept them before you can use a paid feature. Nothing you have already done will be charged for.
3. Your account
- An account is for one person. Keep your password to yourself. You are responsible for what is done with your account.
- Keep your email address up to date. It is how you sign in, and it is where we send the messages these terms mention.
- If you use SynCaps for an organisation, you confirm that you are allowed to accept these terms for it.
- Tell us straight away at [email protected] if you think someone else has used your account.
4. The studies you upload
Your studies remain yours. You let us store them and process them only to provide SynCaps to you. We do not look at them except when you ask us to help, or to deal with a problem with the service. We do not sell them, share them, or use them for any other purpose, including training software.
No personal identifiers. SynCaps is designed so that we never need to know who your participants are. Every time you upload a study, you do one of two things:
- Declare that the file contains no personal identifiers: no names, email addresses, phone numbers, student or staff numbers, panel IDs (such as Prolific or MTurk IDs), or any other information that identifies a participant, and no participant codes that anyone but you or your organisation could link to people. You are responsible for that declaration being true; or
- Have the participant IDs coded in your browser. Each ID is replaced with a random code before the file leaves your computer, and you download a map of your IDs to the codes. We never receive the map, and cannot help if it is lost.
Comment lines and lines SynCaps does not recognise are removed from every file on upload, because free text can carry personal information.
If we believe a study contains personal identifiers, we will suspend it and email you to say why and what you must do to lift the suspension. For an uploaded study this is usually to delete it and upload it again with the identifiers removed or replaced with codes. While a study is suspended you can download it or delete it, but nothing else. If the problem is not resolved within 30 days, we will delete the study. Suspension does not extend how long the study is kept (section 5).
You are responsible for having the right to use the data you upload, and for any obligations you owe to your participants.
5. How long studies are kept
- A study is kept for six months from the day you import it. The date is shown on the study and in your list of studies.
- At the end of that date the study closes. We send you one email to say so. For the next 30 days you can download the study file and your merged sets, but nothing else.
- After those 30 days the study is deleted, with everything made from it. Copies may remain in our backups for about a month more, and are then gone.
- You can delete a study yourself at any time.
- To go on working with a study after it closes, import its file again. That starts a new six months.
Keep your own copies of your original files. SynCaps is not a backup service.
6. Using SynCaps properly
You must not:
- upload anything unlawful, or anything you do not have the right to upload;
- try to reach another person's account or studies, or test, probe or overload the service;
- use automated means to sign up, sign in or use SynCaps, except as we allow;
- resell or share access to SynCaps.
7. The service
We work to keep SynCaps available and correct, but we cannot promise that it will always be available or free of errors. We may suspend it for maintenance, or at once if its security is at risk.
SynCaps produces statistical analyses. Interpreting them, and any decisions you make from them, are your responsibility.
8. Our liability
Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that the law does not allow us to limit.
Otherwise, while SynCaps is free, our total liability to you for anything arising from SynCaps is limited to £100. We are not liable for loss of profit, business or opportunity, or for indirect loss.
If you use SynCaps as a consumer, your legal rights as a consumer are not affected by these terms.
9. Ending your use of SynCaps
- You can stop using SynCaps whenever you like. You can close your account yourself from your account page, which deletes it and your studies, or ask us to at [email protected].
- We may suspend or close your account if you break these terms. If the breach is not serious, we will tell you first and give you the chance to put it right.
- We may end early access, or SynCaps itself. If we do, we will give you at least 30 days' notice by email, and you will be able to download your studies.
10. Changes to these terms
If we change these terms, we will publish the new version here with a new version number and email you about any change that matters. We record which version you accepted. If you do not accept a new version, you can close your account.
11. Law
These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction. If you are a consumer living in Scotland or Northern Ireland, you may also bring proceedings in your local courts.
